Model State Electronics Product Stewardship Legislation

Over the past year, state and local government officials have increasingly been asked to develop a position for their agency on how to manage the growing electronics waste problem. State legislators, in response to constituent demand, have floated their own proposals, while state officials have been called on to respond to these and other initiatives.

Concerned that the NEPSI process was moving too slowly, many state and local government officials began to seek a more immediate solution, and asked PSI to develop model state legislation. With extensive input from many of its 26 state and 24 local government members, PSI drafted model state legislation that incorporated much of the progress made in the NEPSI process.

PSI has developed a performance-based legislative model for consideration by its member states. This model is offered as a starting place for state legislators and environmental agency officials to craft their own legislation. PSI is considering the development of two other models, one which would establish an advanced recycling fee to be deposited into a trust fund managed by a private (third party) corporation, and another model that would establish an advanced recycling fee managed by the state. These three models are “archetype” bills that represent the three basic types of approaches identified as most worthy of consideration by the government officials most involved in the NEPSI process.
